Update:

Just prior to the Conceptual Review at the February 8, 2021 Planning Board XYZ Dairy, LLC received communication from the Planning Department that the City had reversed course on their position regarding the Beyerle paper street. That was communicated ASAP to the neighborhood email list, and we responded with a formal letter requesting a Continuation. During the 2/8/2021 hearing we informed the Planning Board and Staff that our application would be changing in light of the new information.

Our Attorney requested the City Attorney’s full position on the 1912 Beyerle subdivision paper streets as they impact our properties, and other homeowners, in the Crafts Avenue neighborhood:
February 9: Communication from Atty. Hastings to City of Lebanon regarding paper streets

On March 4th, XYZ received word from the Planning Department that our Conceptual Review had been included on the Agenda for the March 8, 2021 Planning Board. Having not yet received the requested opinion from the City, we responded immediately with a letter seeking to correct the record to establish, once and for all, the proper boundaries of Parcels 58-18 and 58-20, ownership of the segment of the disputed ROW, and request a Lot Line Adjustment.
March 4: Communication from XYZ to City of Lebanon regarding Lot Line Adjustment

On March 8th, XYZ Dairy, LLC submitted a formal Lot Line Adjustment application to the Lebanon Planning Department to appear on the April 12, 2021 Planning Board Agenda. This is a formal application, not a Conceptual Review as was done previously, so abutter notifications will go out via the City’s protocols.

On January 11, 2021 Lyme Properties, in its role as the development agent for XYZ Dairy, LLC, submitted an application to the Lebanon Planning Department for a Conceptual Review of a proposed subdivision of Parcels 58-18 and 58-20. This is in response to the City’s declaration of ownership of four “paper streets” to the west of Crafts Avenue in response to a complaint regarding so-called Dartmouth Street.
